Texas Department Of Aging And Disability Services
The Texas Department of Aging and Disability Services (DADS) is responsible for licensing, certifying, and regulating assisted living communities in the state. DADS provides a comprehensive list of assisted living regulations and requirements, which can be found on its website. Additionally, they ensure that communities are providing quality care to residents by conducting routine inspections and surveys to ensure compliance with applicable laws and regulations.
Texas Assisted Living Regulations
The Texas Department of Aging and Disability Services is responsible for administering the Texas Assisted Living Regulations, which outline all requirements that must be met for a community to receive and maintain its license.
The regulations include provisions for team members’ training and qualifications; health services; housekeeping, dietary, laundry, and other personal services; safety measures; fire prevention and protection measures; medical and social service programs; staffing requirements; and other matters related to resident care.
In addition, the regulations specify the rights of residents in an assisted living community, such as their right to privacy, freedom from abuse and neglect, communication with family and friends, transportation services, and more.
Types of Licenses
With that said, assisted living communities in Texas may hold one of two types of licenses.
The first type is the Type A license, which is for communities that offer care to those who are physically and psychologically capable of leaving on their own, without the assistance of carers or personnel (electric carts and wheelchairs are allowed). They must be cognitively able to follow directions and protocol in the case of an emergency. Type A licensed communities typically refer to assisted living communities.
On the other hand, the second type is the Type B License, which refers to communities that provide care to those who require help and are unable to follow directions and procedures in an emergency. With that said, a Type B license is also required for any community that assists those with memory-related conditions like dementia or Alzheimer’s. As such, Type B communities typically refer to memory care communities.
